CHRONOLOGY OF EVENTS IMPORTANT TO SAN DIEGO VOTERS FOR 2008 - CONDENSED
Nov. 2002 KEVIN SHELLEY (D) was elected as California Secretary of State. During his tenure he was
besieged with multiple investigations of his political and professional conduct. Among other
things, he was blamed for poor planning and oversight and for DELAYING THE ALLOCATION
OF MONEY TO COUNTIES TO BUY VOTING MACHINES.
Dec. 2003 The San Diego County Board of Supervisors vote unanimously to spend $31 million on
10,200 Diebold electronic voting machines after two years of study.
Mar. 2004 The $31 million Diebold touchscreen voting system malfunctioned in San Diego County during
the March 2004 primary, causing more than one-third of the polling places to open late.
Feb. 2005 Secretary of State Kevin Shelley resigns under pressure. He had banned San Diego and three
other counties from using Diebold machines for the upcoming fall '06 elections. He had given
counties using electronic voting technology until Nov. '06 to adopt a system with a paper trail.
Mar. 2005 Bruce McPherson (R) was nominated by Gov. Schwarzenegger to replace Shelley and he was
confirmed unanimously by both houses of the California State Legislature.
While serving as the unelected Secretary of State, McPherson approved the use of Diebold
electronic voting for California, against the objections of his own experts and without any public
hearings and without waiting for the results of a pending federal review of Diebold code. He
approved it late on a Friday before a holiday weekend, with little news coverage.
Nov. 2006 Debra Bowen (D) was elected as the new California Secretary of State. She said recently,
"People need to have confidence their votes are counted exactly as they were cast. If we
fail to ensure the integrity of our voting system, we'll do little but undermine the foundation
of our democracy."
On May 9, 2007, Debra Bowen unveiled her unprecedented plan for a Top-to-Bottom review
of California's elections systems.
Apr. 2007 Mikel Haas, the San Diego County Registrar of Voters is promoted to the position of deputy
chief administrative officer of the County's Community Services Group, a job in which he
oversees six county departments, including the Registrar of Voters.
Apr. 2007 Michael Vu was appointed by Mikel Haas to be the new San Diego County Assistant
Registrar of Voters.
Vu started his new job Monday, April 9, less than six weeks after stepping down as
executive director of elections for Cuyahoga County, Ohio. His resignation followed a
tumultuous 3 1/2 year tenure as elections chief, which included a disastrous May 2006
Primary when the county began using new electronic voting machines. Media reports
said that many poll workers failed to show up or were ill prepared to deal with the
machines. Cuyahoga County also lost dozens of memory cards containing vote counts.
Vu was also at the helm for the 2004 presidential recount in Cuyahoga County in which two
workers received felony convictions for rigging the recount to avoid a more thorough review
of ballots. Vu defended the poll workers, saying they followed long-held procedures.
May, 2007 Deborah Seiler was appointed to serve as the new San Diego Registrar of Voters.
Between 1991-1999 she worked as a director of customer relations for a major electronic
voting machine company, SEQUOIA PACIFIC SYSTEMS. From 1999-2004 she worked as a
sales representative for DIEBOLD ELECTION SYSTEMS.
As a DIEBOLD sales rep, she was directly involved in the successful effort to sell the DIEBOLD
election systems to San Diego County in 2003.
When DIEBOLD's contract comes up for renewal or when there are disagreements, many
question where her loyalty will be, with DIEBOLD or with the citizens and voters in
San Diego County.
"Seiler is known as one of the best PR people or apologists for secret vote-counting that exists
in the nation, and she's coming to San Diego," voting integrity activist Paul Lehto said.
Aug. 2007 California Secretary of State, Debra Bowen, released her decision on E-voting for California,
following an unprecedented, independent "Top-to-Bottom Review" of all certified electronic
voting systems used in California elections. She released her decision in time to meet state
requirements for changes in voting system certification.
She announced that she will be disallowing the use on election day of DRE's ( Direct Recording
Electronic voting systems, mostly touchscreens) made by DIEBOLD and SEQUOIA, but for one
DRE machine per polling place which may be used by disabled voters. The paper trails from
votes cast on DRE's manufactured by those two companies must be 100% manually counted
after the election. San Diego uses DIEBOLD machines exclusively
Dec.18,2007 San Diego Registrar Seiler(Past DIEBOLD and SEQUOIA employee) and San Diego County (Supervisors) filed a lawsuit against the California Secretary of State in defiance of her
mandate to increase post election audits to 10% from the existing 1% audit required for every
election, but only where the margin of victory is one half of 1%. Bowen's mandate requires
vendors to pay for the audit. The County maintains that it will incur substantial costs because
"San Diego's vendor (formerly DIEBOLD ELECTION SYSTEMS, Inc., now known as "PREMIER
ELECTION SYSTEMS", same company, new name ) has stated that it will not pay for the audit.
San Diego, joined by three other counties (Kern, Riverside and San Bernardino), decided to sue the Secretary of State and not the vendor that is threatening to break the law.
Jan.25,2007 San Diego filed a request for emergency relief in the Court of Appeal.
Jan. 29,2007 The Appeal was rejected. Superior Court Judge Patricia Cowett ruled that Secretary of State
Bowen had the power to order counties to conduct hand recounts of 10% of precincts when
races were close at the end of voting.
Only time will tell what our Registrar and our Supervisors choose to do next. Touchscreen voting machines and Optical Scanners across the country are producing very odd election results nationwide in this season
of presidential primaries. As citizens, we need to pay attention to what is happening to our elections and
